The National Student Financial Aid Scheme (NSFAS) has urged landlords not to require a deposit or top-up payment from NSFAS-funded students.

This arrives right after NSFAS obtained stories about some accommodation providers who need NSFAS-funded students to pay a deposit or top-up payment in order to get access to the accepted private accommodation.

"NSFAS reminds accommodation vendors in the obligatory conditions, as furnished by the Standardised Fixed-Term Lease Settlement among the non-public accommodation companies and NSFAS funded students," NSFAS stated in an announcement on Thursday.

The Standardised Fixed-Term Lease Agreement states which the rent might be paid regular monthly on the accommodation supplier (lessor) by NSFAS, on behalf from the lessee (NSFAS funded student), in accordance with the NSFAS conditions and terms for private accommodation companies’ participation on the student accommodation portal.

"The lessor may not call for or permit the lessee to pay a deposit, top-up payments, or some other forms of payment to your lessor, or almost every other person in reference to this arrangement, together with payment of hire, although awaiting payment from NSFAS. The lessor shall have no recourse from the lessee for any default from the payment of rent by NSFAS," the arrangement reads.

The NSFAS conditions and terms for private accommodation companies’ participation on the student accommodation portal also nsfas status check states that: "Where the NSFAS-funded student is defunded due to an incorrect selection by NSFAS, the student will not be responsible for payment of any arrear rent to the accommodation company, up right up until the day of being defunded."

The scheme emphasised that any dispute arising between the parties regarding the interpretation or implementation of the agreement, must be dealt with in accordance with any dispute resolution procedure determined by NSFAS for nsfas allowances this purpose.
